Braniff, et al. v. HCTec Partners, LLC, f/k/a HCTec, LLC – Unpaid Overtime Settlement

Berger Montague served as co-lead counsel and obtained a $4.5 million settlement in this wage and hour lawsuit against HCTec Partners, LLC, f/k/a HCTec, LLC on behalf of approximately 2,271 individuals employed in the United States as Consultants during the time period at issue. Led by Shanon J. Carson and Alexandra K. Piazza of Berger Montague, the plaintiffs brought this unpaid overtime case alleging violations of the federal Fair Labor Standards Act, 29 U.S.C. § 201, et seq. (“FLSA”) and applicable state laws. The case was litigated in the United States District Court for the Middle District of Tennessee and was captioned Braniff, et al. v. HCTec Partners, LLC, f/k/a HCTec, LLC, No. 3:17-cv-00496 (M.D. Tenn.).

The plaintiffs were non-exempt, hourly paid Consultants who were staffed by HCTec on projects throughout the country to provide support and training to hospital staff in connection with training on new electronic recordkeeping systems. Plaintiffs routinely worked well over forty (40) hours per workweek, throughout the duration of their assignments, and were paid only a straight hourly rate, with no overtime pay for hours worked in excess of forty. Additionally, some of the plaintiffs were required to undergo mandatory training, for which they did not receive minimum wage. Plaintiffs primarily claimed that they were not paid for all hours worked and were denied overtime pay at 1.5 times their regular rate as required by the FLSA and applicable state laws. The settlement resolved the claims alleged in the action.
