Led by Camille Fundora Rodriguez of Berger Montague, the plaintiff brought this unpaid overtime case alleging violations of the federal Fair Labor Standards Act, 29 U.S.C. § 201, et seq., and New Jersey Labor Laws. The case was litigated in the United States District Court for the District of New Jersey and was captioned Brewer v. Homeland Vinyl Products, Inc., No. 1:17-cv-04290-NLH-KMW (D. N.J.).
The plaintiffs were non-exempt, hourly paid Machine Operators and other employees who worked in Homeland Vinyl’s production facilities. Plaintiff and operators routinely worked well over forty (40) hours per every other workweek, throughout the duration of their assignments, but their overtime hours were averaged between two weeks, resulting in approximately four (4) hours of overtime per two weeks that was paid at a straight time rate. Plaintiff primarily claimed that operators were not paid for all hours worked, suffered unlawful deductions, did not have their shift differentials calculated into their overtime rate of pay, and were not paid an overtime rate when they worked more than forty (40) hours per week. The settlement resolved the claims alleged in the action.
