Gentry, et al., v. Scientific Drilling International, Inc. – Unpaid Overtime Settlement

Berger Montague served as co-lead counsel and obtained a $4.45 million settlement in this wage and hour lawsuit against Scientific Drilling International, Inc. on behalf of approximately 745 individuals employed in the United States as Measurement While Drilling (“MWD”) Hand Technicians and Survey Field Technicians during the time period at issue. Piazza of Berger Montague, the plaintiffs brought this unpaid overtime case alleging violations of the federal Fair Labor Standards Act, 29 U.S.C. § 201, et seq. (“FLSA”) and North Dakota and Wyoming Labor Laws. The case was litigated in the United States District Court for the Southern District of Texas and was captioned Gentry, et al., v. Scientific Drilling International, Inc., No. 4:14-cv-00363 (S.D. Tex.).

The plaintiffs were non-exempt employees, including MWD Hand Technicians and Survey Field Technicians, who were employed by Scientific Drilling to complete manual labor on oil rigs. Scientific Drilling paid these employees on a salary plus day rate basis. Plaintiffs routinely worked well over forty (40) hours per workweek, throughout the duration of their assignments, and were paid only their fixed weekly salary plus a day rate for each day they work in the field, with no overtime pay for hours worked in excess of forty. Plaintiffs primarily claimed that they were not paid an overtime rate when they worked more than forty (40) hours per week. The settlement resolved the claims alleged in the action.
