Overview
Case Number: 6:26-md-03187-EFM-BGS (MDL No. 3187)
Practice Area: Antitrust
Court: United States District Court for the District of Kansas
Berger Montague is interim co-lead counsel for a proposed class of direct purchasers of nitrogen, phosphate, and potash fertilizers (NPK Fertilizers). The case alleges that the dominant U.S. fertilizer producers conspired to fix, raise, and maintain NPK Fertilizer prices from January 2021 to the present, in violation of the Sherman Act.
Defendants include Nutrien, The Mosaic Company, CF Industries, Koch, Yara, and Canpotex, the potash export venture Nutrien and Mosaic jointly own, along with The Fertilizer Institute and the International Fertilizer Association. Plaintiffs allege the defendants control 82% of the U.S. nitrogen market and roughly 90% of the North American phosphate and potash markets. Prices surged in lockstep in 2021 and 2022, eased only partly in 2023, and climbed again from 2024, while defendants curtailed production and idled plants.
In June 2026, the Judicial Panel on Multidistrict Litigation centralized the cases in the District of Kansas before Judge Eric F. Melgren.
