Berger Montague served as class counsel and obtained a $3.8 million settlement on behalf of current and former Transamerica Corp. employees who alleged the company breached its fiduciary duties owed to them under the Employee Retirement Income Security Act, 29 U.S.C. § 1000, et seq., (“ERISA”). The plaintiff employees alleged that Transamerica Corp. violated ERISA by failing to properly administer its 401(k) plans and failing to act in the best interest of the plan participants when it offered investment options that benefited the company, charging employees excessive investment management and administrative fees. The case was litigated in the United States District Court for the Northern District of Iowa.
