Piazza of Berger Montague, the plaintiffs brought this unpaid overtime case alleging violations of the federal Fair Labor Standards Act, 29 U.S.C. § 201, et seq. (“FLSA”) and New York Labor Laws. The case was litigated in the United States District Court for the Eastern District of New York and was captioned Manemeit v. Lifetouch National School Studios, Inc., No. 2:16-cv-03803 (E.D.N.Y.).
The plaintiffs were non-exempt, Photographers who were employed by Lifetouch and paid on a day rate basis. Lifetouch required Plaintiffs and the other Photographers to travel between the Lifetouch office and assorted photography locations in order to perform photography services for students and school-related events throughout the nation. Plaintiffs routinely worked well over forty (40) hours per workweek, throughout the duration of their assignments, and were paid only a straight day rate, with no overtime pay for hours worked in excess of forty. Plaintiffs primarily claimed that they were not paid an overtime rate when they worked more than forty (40) hours per week. The settlement resolved the claims alleged in the action.
