Berger Montague, together with co-counsel Terrell Marshall Law Group PLLC and Freedman Normand Friedland LLP, represents consumers in this Antitrust class action lawsuit filed against Expedia Group, Inc., the online travel company behind Expedia.com, Hotels.com, and other booking sites, alleging that Expedia used its dominance in online hotel booking to keep hotel prices artificially high across the country.
On October 2, 2026, consumers filed a proposed class action in the U.S. District Court for the Western District of Washington alleging that Expedia violated Sections 1 and 2 of the Sherman Act. According to the complaint, Expedia, which allegedly facilitates nearly 80% of U.S. online travel agency hotel bookings by value, requires hotels to agree not to offer lower rates on their own websites and uses pricing algorithms to demote hotels in its search results when they offer lower rates on rival sites such as Booking.com. Plaintiffs allege these practices inflated hotel prices for consumers nationwide, including those who never booked through Expedia. Plaintiffs seek damages and a court order ending the challenged practices.
