Michelle Drake to Speak at Harvard Plaintiffs’ Law Association

Executive Shareholder, E. Michelle Drake, a Harvard Law School graduate herself, will speak at the Harvard Plaintiffs’ Law Association (HPLA) as a co-chair in the Consumer Protection practice at Berger Montague. HPLA is a student organization at Harvard Law School that exists to support law students looking to become plaintiffs attorneys who will represent the interests of victims, advocate for consumers’ rights and equal access to justice, as well as ensure that any person who is injured by the misconduct or negligence of others can obtain justice in America’s courtrooms.

Ms. Drake’s session, “Wrongly Accused of Terrorism and Drug Trafficking: A Case Study of One U.S. Navy Official’s Battle,” will take place on Thursday, October 17th. Throughout the session, she will be sharing about her recent success in a Fair Credit Reporting Act case involving allegations that class members were wrongly flagged as potential terrorists and drug traffickers and were denied access to credit as a result.

The lead plaintiff in the case, Marco Fernandez, was denied a mortgage after he was reported as a potential match for a drug trafficker, even though the plaintiff had a different age, name, and date of birth than the suspected trafficker. Further, the plaintiff, Mr. Fernandez, was a cybersecurity official in the U.S. Navy with a top secret clearance.
