Berger Montague served as co-lead counsel and obtained a class action settlement against Volkswagen Group of America, Inc. on behalf of purchasers and lessees of certain 2019 Volkswagen Jetta or 2018, 2019, and/or 2020 Volkswagen Tiguan vehicles equipped with 8-speed transmissions susceptible to possible oil leaks, rattling, hesitation, or jerking. The case, which asserted claims for breach of warranty and consumer fraud, was litigated in the United States District Court for the Central District of California and was captioned Parrish, et al. v. Volkswagen Grp. of Am., Inc., No. 8:19-cv-01148 (C.D. Cal.).
The Settlement
Settlement class members with Jettas who delivered their vehicle to an authorized Volkswagen dealer with a diagnosed and confirmed transmission rattling noise were eligible to obtain an update of the vehicle’s transmission control module software and installation of a damper weight on the drive shaft, free of charge.
Settlement class members with Jettas were also able to recover up to 100% reimbursement for out-of-pocket costs of repairs to address a diagnosed transmission rattling noise if paid within 72,000 miles. Volkswagen also provided a one year/12,000 mile extension of the warranty (and up to 100% reimbursement for already incurred expenses) for repairs by an authorized Volkswagen dealer to address a diagnosed and confirmed oil leak caused by the transmission oil cooler seal rings for settlement class members with Jettas who had a previous Transmission Oil Cooler Seal service action performed.
Settlement class members with Tiguans were able to recover up to 100% reimbursement for out-of-pocket costs for repairs to address a diagnosed condition of transmission hesitation or transmission jerking if paid within one year/12,000 miles after the class member’s original warranty expired.
Volkswagen also provided a one year/12,000 mile extension of the warranty to cover repairs by an authorized VW dealer to address a diagnosed condition of transmission hesitation or jerking if the vehicle already had a previous Recall action performed.
