Case Summary

In the four cases above, Berger Montague and co-counsel alleged a defect in Toyota’s 8-Speed Automatic Transmission equipped in the 2018-2019 Toyota Camry; the 2019-2020 Toyota RAV4; the 2017 to present Toyota Highlander; the 2017 to present Toyota Sienna; and the 2016 to present Lexus RX 350. hesitation, jerking, unintended acceleration, lurching, excessive revving before upshifting (also known as excessively high RPM shift points), and lack of power when needed (such as from a stop). Toyota filed myriad motions to dismiss in the actions, which Plaintiffs opposed.

After over a year of briefing these motions, Plaintiffs’ principal claims and statewide sub-classes were sustained. Toyota filed its Answer in the Loo, Murphy, and Quinones actions. Toyota’s final motion to dismiss was pending in the Peguero action and discovery was underway when the parties engaged in mediation. The parties resolved the litigation in a confidential settlement. Russell Paul, Amey Park and Abigail Gertner were responsible for this matter.
