Berger Montague, with its co-counsel, asserted claims against General Motors, LLC, on behalf of consumers who purchased or leased certain 2010 to 2022 Chevrolet Camaro vehicles (“Class Vehicles”) for violations of the express and implied warranty statutory provisions, the Magnuson-Moss Warranty Act, 15 U.S.C. § 2301, et seq., and certain state consumer fraud statutes.
The Complaint Details
The complaint alleged that, unbeknownst to Plaintiffs and other consumers when they purchased their Class Vehicles, the Class Vehicles contain design, manufacturing, and/or workmanship defects which cause the starter to fail well before the useful life of the part (the “Starter Defect”).
As a result, the starters in the Class Vehicles are prone to failing, which also taxes the associated electrical systems, prematurely draining batteries and damaging other system components leading to costly repairs. The defectively designed and/or manufactured Class Vehicles and their starts present a safety hazard and are unreasonably dangerous to consumers.
When the starter suddenly and unexpectedly fails, the Class Vehicles lose power, a clear-cut safety risk which can increase the risk of collisions. General Motors concealed the Starter Defect from consumers. A confidential settlement was reached in this matter. Russell Paul, Amey Park, Natalie Lesser and Abigail Gertner were responsible for this matter.
