Berger Montague Expands Antitrust Department with Two Heavyweight Lateral Hires
January 5, 2022, PHILADELPHIA, PA: Berger Montague, a nationally recognized plaintiffs’ class action and commercial litigation law firm, is pleased to announce that Prof. Josh Davis and Dr. Robert Litan, two of the nation’s top antitrust practitioners and scholars have agreed to join the firm. For nearly two decades Prof. Davis held a tenured professorship at the University of San Francisco School of Law, during which time he developed particular expertise in litigating antitrust class actions. Dr. Litan, who has a Ph.D. in economics, worked in the Antitrust Division of the Department of Justice, has litigated major complex antitrust matters, and has authored or co-authored thirty books. Both are highly accomplished and will bring to bear an enormous amount of insight and experience on behalf of the firm’s clients.
Prof. Davis will also hold the position of Research Professor at the University of California, Hastings College of the Law, where he is associated with the Center for Litigation and Courts. He is one of the leading practitioners and scholars in the nation on class certification in antitrust cases in particular, class certification in general, and class action and complex litigation ethics. Prof. Davis will run the firm’s inaugural San Francisco Bay Area Office.
Dr. Litan is one of the few practicing lawyers (in any field, including antitrust) with a Ph.D. in economics and an extensive research and testimonial career in economics. During his legal career, Litan has specialized in administrative and antitrust litigation, concentrating on economic issues, working closely with economic experts—having been a testimonial witness in more than 20 legal and administrative proceedings himself.
Both attorneys are also heavily involved in business and community leadership as Prof. Davis is on the Board of the American Antitrust Institute, and serves as President of the Board of Cafe Puente, a local nonprofit that builds connections between Spanish-speaking and English-speaking communities and has served on the Board of Canal Alliance for a decade. Dr. Litan has served on numerous private, non-profit, and government boards and currently is a member of the advisory boards of the American Antitrust Institute and the Center for Regulation and Markets at the Brookings Institution.
Eric L. Cramer, Chairman of the firm, who is also a Co-Chair of its antitrust department, had this to say about the hiring of these two legal heavyweights: “We and our clients are extremely fortunate that preeminent lawyers and scholars on the level of Josh and Bob have agreed to join us as shareholders. They bring a one-two punch of expertise and talent that we believe will make our top-rated antitrust and appellate practices second to none.”
