$125 Million Settlement Reached in Drywall Price-Fixing Lawsuit

January 3, 2018. PHILADELPHIA – Berger Montague is pleased to announce that on December 29, 2017, affiliates of American Gypsum Co., National Gypsum Co., and PABCO Building Products LLC agreed to pay a class of drywall direct purchasers $125 million to settle price-fixing allegations. This latest settlement brings the total amount of settlements for the class to $190.7 million.

Plaintiffs in this class action have alleged that the dominant manufacturers of drywall in the United States engaged in a conspiracy during 2012 and carrying over into 2013 to fix drywall prices in the U.S. and abolish the industry’s longstanding practice of limiting price increases for the duration of a construction project through “job quotes.”

On August 20, 2015, the U.S. District Court for the Eastern District of Pennsylvania granted final approval of two settlements—one with USG and the other with TIN Inc.—totaling $44.5 million. On December 8, 2016, the district court granted final approval of a $21,169,292 settlement with Lafarge North America, Inc.
